Appellate court upholds child sex abuse conviction of Monsey man

NEW CITY – The Appellate Division
of State Supreme Court has affirmed the conviction of a Monsey man who
pled guilty in Rockland County court to sexually abusing a child.

Shmuel Dym, 34, pled guilty in June 2012 to two felony counts each of
course of sexual conduct against a child and endangering the welfare of
a child.

On appeal, Dym sought to withdraw his guilty plea based on his claims
that it was coerced by his attorneys.

The Appellate Division ruled that claim “was not borne out by the
record” and contrary to his contention, Dym was not deprived of
effective assistance of counsel.

When he pled guilty, Dym admitted to improperly touching two young brothers,
ages even and eight, several times during a three-month period.
