Ulster man loses appeal of aggravated family offense charge

KINGSTON – The Appellate Division Third Department Thursday unanimously affirmed the July 2019 conviction of James Streater upon his plea of guilty convicting him of the crimes of aggravated family offense and criminal contempt, both as felonies.

Streater’s conviction stems from his violation of an order of protection and his repeated verbal and physical abuse of one of the protected parties.  He was originally charged with six counts of aggravated family offense and two counts of criminal contempt, but eventually pled guilty to one count each of aggravated family offense and criminal contempt. He also waived his right to appeal in full satisfaction of all pending charges.

 

County Court Judge Donald Williams subsequently sentenced him to consecutive prison terms of two to four years on each count.

 

On appeal, although the Appellate Division Third Department declared the appeal waiver overly broad and invalid, it nevertheless affirmed defendant’s conviction.
