KINGSTON – A group of limited liability companies has filed an Article 78 proceeding against the City of Kingston challenging the sufficiency of a public hearing held by the common council regarding the partial abandonment of Fair Street Extension. The group also sought a temporary restraining order and preliminary injunction blocking the implementation of proposed resolution 251 that authorized the partial abandonment of Fair Street.

In an agreement by and between the parties involved – namely the city and the attorneys for the LLCs – the council resolution is rescinded, and a new public hearing will be held.

The closure of a portion of Fair Street was designed to pave the way for a plaza as part of the Kingstonian project.
