KINGSTON – The Appellate Division of State Supreme Court has affirmed the drug conviction of a state prison inmate.
Eladio Boudier had been convicted of felony drug possession and sentenced in Ulster County Court to two years in prison with three years of post-release supervision.
The case stemmed from his plan to have a female friend bring drugs into the correctional facility where he was incarcerated.
On appeal, Boudier challenged the voluntariness of his plea, but the appellate court ruled his own statements and actions during the plea proceedings contradicted his claims of coercion and undue pressure.
