GOSHEN – An Orange County grand jury has indicted a Middletown man on a charge of perjury in connection with the grand jury investigation into the shooting of a man outside the You You Asian Restaurant on Route 211 in the Town of Wallkill.

Hector Luna, Jr., 27, of Wallkill, had been indicted on charges of attempted murder, assault and criminal possession of a weapon for allegedly shooting a man as he left the restaurant.

During the investigation into the incident, it was discovered that Eric Rivera, 30, of Middletown, was with Luna and had witnessed the shooting.

Rivera’s perjury charge stemmed from having testified falsely during that grand jury’s presentation.

After the shooting, Luna fled and was taken into custody at the Hampton Inn hotel in Pike County, Pennsylvania. He waived extradition to face charges in New York.
