Appeals court rejects effort to overturn burglary conviction

KINGSTON – The Appellate Division of State Supreme Court has affirmed the December 2015 conviction of a Saugerties man, who was convicted of felony burglary.

Marc Daniels had broken into a Town of Ulster home in the early morning hours of July 12, 2014 while the residents were sleeping.

He stole a car, several items including a debit card and fled in the stolen Audi TT Coupe. Along the way, he filled the car with gas using the stolen debit card but abandoned the vehicle a short time later.

In satisfaction of a three-count indictment, Daniels pled guilty to burglary as a second felony offender and waived his right to appeal in exchange for a seven-year prison sentence to be followed by five years of post-release supervision.

On appeal, he challenged the validity of his appeal waiver, the voluntariness of his plea and the severity of his sentence.

The appeals court rejected all of Daniels’ arguments.
