Riverkeeper appeals NRC decision to transfer Indian Point’s license to Holtec

OSSINING – The Riverkeeper environmental organization has filed an appeal before the U.S. Court of Appeals for the District of Columbia Circuit challenging the Nuclear Regulatory Commission’s approval of the Indian Point nuclear power plant license transfer to Holtec International without a public hearing.

Indian Point, in Buchanan, will shut down completely in less than a month and Riverkeeper, through its Director of Legal Programs Richard Webster, contends the NRC violated federal law, regulations and policy by not holding a hearing.

“Holtec would tell you that they can go ahead and do the transfer while the issue is under appeal; I think that we have the other opinion that no transfer should happen until the appeal is resolved, and there is the question of the state process still going on and the Public Service Commission, which is still open. I don’t think the transfer can occur until at least that is resolved,” he said.

And, Webster does not think that will be resolved before Indian Point is permanently closed at the end of April.
