Yonkers man sentenced to 50 years in state prison for sexual conduct, rape of child

WHITE PLAINS – A Yonkers man was sentenced in Westchester County Court on Tuesday to 50 years in state prison following his conviction for repeated sexual conduct with a child and rape, Westchester District Attorney Miriam Rocah said.

Starting in 2019, when the victim was 11, and continuing into 2021, the defendant, Yonkers resident Virgilio Cruz, 48, subjected the child to sexual intercourse repeatedly, in some cases was the child was sleeping.

During a separate incident when the victim was 14, he engaged in a struggle with the victim and pinned down and raped the victim.

The victim then reported the rape and history of sexual conduct to a parent and when confronted by the parent, he attempted to stab himself with a kitchen knife at which time the police were called.

Yonkers Police arrested Cruz on September 23, 2021. After a weeklong trial, a jury found him guilty of course of sexual conduct against a child and two counts of rape.

Cruz will also be subject  to 20 years of post-release supervision and will be required to registered as a sex offender after completing his prison sentence.
