Man who shot victim because he thought he was a cop pleads guilty

GOSHEN – A man who shot and wounded another man outside the You You Asian Restaurant and Bar in the Town of Wallkill because he though the victim was a police officer, entered a plea of guilty in Orange County Court to armed assault.

On April 14, 2021, at about 9:15 p.m., as the victim was leaving the restaurant after dinner, Hector Luna, Jr., 28, of Wallkill, shot the man. The victim was administered emergency medical aid by Wallkill Town Police and EMS personnel before being transported to the hospital.

Luna was taken into custody at the Hampton Inn hotel in Pike County, Pennsylvania and waived extradition to face the charges in New York.

Assisting in the investigation were New York State Police, City of Middletown Police, the Orange County Sheriff’s Office, Town of Woodbury Police, the FBI Safe Streets Task Force, Port Jervis Police, Hudson Valley Crime Analysis Center, Eastern Pike Regional Police, Pennsylvania State Police, the Pike County District Attorney’s Office, and Orange County District Attorney’s Office.

“The defendant’s admitted conduct highlights the terrifying consequences of random gun violence,” said DA David Hoovler.

The DA’s office will recommend that Luna be sentenced in January to 7 ½ years in state prison followed by five years of post-release supervision.

“This disposition spares the victim the additional trauma of reliving this horrific incident in front of a jury,” said Hoovler.
