Fleeing NYC suspects that wrecked a school bus in Wappinger given appearance tickets

FISHKILL – Two New York City residents who led police on a car chase on Route 9 on August 12 during a grand larceny investigation at Key Bank in Fishkill have been arraigned and released with appearance tickets.

On August 12, 2022, the State Police and the Village of Fishkill Police arrested 28-year-old Destiny Smith, a Bronx resident, for the misdemeanors of conspiracy, reckless endangerment, and fleeing an officer in a motor vehicle. Jomo Cole, a 30-year-old Bronx resident, and passenger in Smith’s car, was charged with misdemeanor conspiracy.

At approximately 4:25 p.m., the Village of Fishkill Police pursued a vehicle northbound on State Route 9 from the village in connection to a grand larceny investigation from Key Bank. The fleeing vehicle, a 2017 BMW operated by Smith struck a small school bus on Route 9 in the Town of Wappinger and came to rest in a ditch. All occupants of the suspect vehicle and the bus were treated at local area hospitals for minor injuries and released.
Smith and Cole were originally issued appearance tickets returnable in the Town of Wappinger Justice Court on August 22, 2022.  According to Dutchess County Senior Assistant DA Jennifer Fluck, the two were arraigned in the Village of Fishkill Court on August 29, 2022. They were both released on their own recognizance, and their cases were adjourned to September 19, 2022.
