ALBANY – Gregg Marinelli, age 40, a former sergeant in the New York City Department of Environmental Protection Police, who sold a “ghost gun” with no serial number to an outlaw motorcycle club member, who was also a lieutenant in the Middletown City Fire Department, and later tipped him off that he was a target of a police investigation, was sentenced to 10 years in state prison in 2021. Martinelli appealed the sentence claiming that the sentence was excessive. The appeals court recently ruled against Martinelli.
Martinelli also claimed that his sentence was cruel and unusual punishment under the US Constitution. The appellate court did not agree with his argument.
The former cop, serving his weapons and hindering prosecution sentence in the Clinton Correctional Facility is eligible for parole in 2029.
