Localities cannot impose good cause eviction legislation, Beacon maintains

BEACON – While several municipalities in the Hudson Valley have adopted good cause eviction legislation, the City of Beacon received a second opinion that they cannot because that is within the state’s purview.

Months ago the city received an opinion from a law firm specializing in municipal affairs saying that law could not be implemented on the local level.

Now, Mayor Lee Kyriacou sought an opinion from the New York Conference of Mayors saying essentially the same thing.

“We now have two sources, we have a professional municipal law firm which represents us tell us we didn’t have the authority; we have NYCOM who has attorneys and the general counsel wrote to us and they obviously know municipal law really well and want to support cities but said you lack the authority,” he said.

Kyriacou has asked the state attorney general’s office for an opinion, but it hasn’t responded, the mayor said.
