Man loses appeal of Westchester murder conviction

WHITE PLAINS – A former Bronx man who is serving a state prison term of 25 years to life for shooting another man to death in 2014, has lost the appeal of his sentence.

A State Supreme Court jury found Kakau Kiarie of murder for shooting Michael Anthony Santiago to death in Mount Vernon on April 1, 2014.

Kiarie appealed to the Appellate Division of State Supreme Court, Second Department maintaining he suffered from mental disease or defect and that he was deprived of a fair trial by alleged prosecutorial misconduct during the prosecutor’s summation.

In a decision dated September 13, 2021, the appellate division rejected both arguments and affirmed the lower court’s decision.
