State lawmakers announce legislation letting judges set bail for people charged with illegal gun crimes

NEW CITY – State and local officials, Wednesday, announced legislation in Albany that would allow for judges to set bail for anyone charged with illegal sale, use or possession of a gun.

The legislation would expand upon revisions already made in 2020 to the 2019 bail reform laws passed by the state legislature, and makes any offense related to the illegal sale, use, or possession of a firearm eligible for cash bail.

The measure, proposed by Senator Elijah Reichlin-Melnick and Assemblywoman Sandy Galef, has he support of Rockland County Sheriff Lou Falco, District Attorney Tom Walsh and local police chiefs.

Lawmakers said as gun violence has sharply risen across the nation and state, this newly expanded discretion for judges would give law enforcement a critical tool to keep those involved with gun violence off the streets while awaiting trial.
