Arrest made in fatal hit and run

MONTICELLO – The Sullivan County Sheriff’s Office has made an arrest in the fatal hit-and-run accident that occurred on Route 52 in the Town of Liberty on Saturday night.

Dennis Toscano, 60, was unloading groceries from his car when a vehicle struck and killed him and fled the scene.

Detectives found pieces from a Subaru Legacy at the scene which led them to Joseph Maxwell, Jr., 34, of Liberty.

He was taken into custody on Sunday evening at his Eagle Drive home.

The District Attorney’s Office prepared a search warrant which was executed on Monday morning. A 2012 Subaru Legacy with a smashed windshield and front-end damage was recovered from the garage.

Maxwell was charged with the felony of leaving the scene of a fatal motor vehicle accident. He was arraigned and remanded to the Sullivan County Jail in lieu of $50,000 bail.

Sheriff Mike Schiff said the investigation is continuing and additional charges are being considered.

He thanked the public for the confidential tips that came into his office during the investigation.

Sheriff’s deputies were assisted by the Liberty Fire Department, State Police uniform and BCI members, Village of Liberty Police, district attorney investigators, and State Department of Transportation.
