KINGSTON – The Appellate Division of State Supreme Court has affirmed the burglary conviction of a former Plattekill man.
Christopher Williams pled guilty in December 2017 to a burglary charge admitting that he stole property from a private home to support his drug habit.
As a condition of his guilty plea, he waived his right to appeal and was sentenced to eight years in prison and five years of post-release supervision.
Williams did appeal his conviction claiming his waiver was not valid, but the appellate court disagreed.
“The record discloses that county court advised defendant of the trial-related rights that he was forfeiting by pleading guilty and clearly indicated that the right to appeal was separate and distinct from those rights,” the appeals court wrote in a July 20 decision.
