Sullivan County sex offender arrested in Dutchess County

VILLAGE OF FISHKILL – A 30-year-old Sullivan County man, a Level 3 sex offender wanted by the Sullivan County Sheriff’s Office, was arrested by Village of Fishkill Police on Saturday night at the Hawthorn Suites hotel.

Police were flagged down by an employee of the hotel to report suspicious behavior by one of the guests.  Allegedly, Fonseca and a female companion were staying at the hotel.  At some point, Fonseca gained access to the staff laundry room and was confronted by the desk clerk.  After a brief conversation in the employee area, Fonseca left and returned to his room.

Shortly after the encounter, the desk clerk realized that his wallet was missing, and notified the manager who called the police.  Two officers went to the room were Fonseca was staying to inquire about the wallet.  Both he and his co-tenant denied having the item.  One of the police officers recognized Fonseca as being wanted by the Sullivan County Sheriff for failing to register as a sex offender.  Officers left the room and returned to their vehicles to confirm the warrant and contact the Sullivan County authorities.

Sullivan County confirmed the warrant and indicated that they would extradite him if Fishkill would proceed with the arrest.  Officers returned and took Fonseca into custody, processed him in their headquarters, and then transported him to the Newburgh area where his custody was handed over to an awaiting Sullivan County deputy.

Fonseca was sentenced to prison for rape in the third degree in 2000.  He was an employee of a mental health institution and raped a 32-year-old female patient.  Court documents indicate that the patient had the mental capacity of an eight-year-old child.  

The registered sex-offender also has arrests for felony welfare fraud, failing to report an address change as required of sex offenders, resisting arrest, and a host of other charges.
