State Commission: Sullivan County Court judge should be removed

ALBANY – The State Commission on Judicial Conduct has determined that Sullivan County Court Judge Michael McGuire be removed from office for misconduct and abuse of authority.

McGuire, who also served as judge of Surrogate’s Court, acting judge of the Family Court and an acting justice of the Supreme Court, was appointed recently as the new Sullivan County Government attorney.

Among the charges against McGuire in a 66-page decision by the state commission were that he “improperly and without cause ordered litigants, some of whom were not represented by counsel, to be taken into custody in handcuffs on six occasions.”

He also allegedly threatened to order  litigants into custody on three other occasions and was discourteous to court personnel.

McGuire also failed to be courteous toward litigants in a child custody case and that he practiced law while a full-time judge.

It was also charged that he conducted gun permit interviews at inappropriate locations and required his court secretary to work on certain Saturdays without compensation.
