Danskammer overpaid close to $900,000 in special district charges

TOWN OF NEWBURGH – The Danskammer electric generating plant in the Town of Newburgh has been operating since December 1, 2014 under a payments-in-lieu-of-taxes (PILOT) agreement through the Orange County Industrial Development Agency. As part of that arrangement, the company was required to pay special district charges, but officials just learned they exceeded the cap by a total of $896,188.19 and they want it back.

IDA Acting Chief Executive Officer Laurie Villasuso said Danskammer is willing to collect their overpayments, but over seven years instead of the two years remaining on their PILOT.

“They are requesting us to get in touch with the taxing jurisdictions, make sure that everybody understands the situation and then possibly alter some of their documentation so that they can recoup what they overpaid, but over a long period of time so that none of the municipalities are adversely affected in the short term,” Villalsuso said.

The taxing districts impacted include Orange County, the Town of Newburgh, the Marlboro Central School District and the special taxing districts of the Middle Hope Fire District and Consolidated Water Districts One and Two.
