Federal judge dismisses wrongful firing charges against Orange County officials

WHITE PLAINS – A US District Court judge has granted summary judgment to drop all charges against several Orange County officials who allegedly failed to promote a female corrections officer to the rank of sergeant.

Geisha Falu contended that despite her eligibility, the officials failed to promote her motivated by sex-based discrimination.

The county sought summary judgment to dismiss the claim and Judge Nelson Roman granted that in a decision dated July 30, 2019. The county had argued that Falu had scored an 85 on the civil service exam for the promotion and that three others who took the test scored a 95, 90 and 87.5. Falu would not have been “reachable” to be offered the promotion until at least nine of the 11 immediately reachable individuals had either been promoted to correctional sergeant or were not interested in the job.

Each of the defendants in the case, County Human Resources Commissioner Steven Gross, Sheriff Carl DuBois, and Jail Administrator Kenneth Decker each had no role in the failure to promote Falu, according to previous court rulings. The case against Undersheriff Kenneth Jones was dismissed in this latest decision.
