Man who fought with Port Jervis police during drug arrest pleads guilty

GOSHEN – A Port Jervis man, whose fight with Port Jervis City Police was captured by a passerby on video, pled guilty in Orange County Court on Monday.

When Shelton Spence, 28, was being taken into custody on May 29, he resisted arrest and a partial recording of that incident was posted on Facebook.

The police asked the district attorney’s office to investigate and on found the officers were justified.

In court on Monday, Spence pled guilty to possession of drugs with intent to sell and to resisting arrest and specifically that he resisted arrest at the time the video was taken. He will be sentenced to four years in state prison.

“We had to investigate the Port Jervis Police for improper use of force; we did so independently of the case,” DA David Hoovler said. “We found the use of force was reasonable.”

Hoovler said his investigation found that Spence “clearly had a motive to flee from the police, and struggle with them, to avoid being arrested with additional narcotics.”
