KINGSTON – A Kingston man, who attacked a 15-year-old boy when he found him kissing his girlfriend’s 14-year-old daughter, has had his conviction upheld.
Edward Evans pled guilty in Ulster County Court in April 2015 to felonies of assault and criminal possession of a weapon in connection with the attack in which he used a nine-inch hunting knife. The victim sustained a slashed wrist and significant physical injury.
Following his guilty plea, Evans was sentenced by County Court Judge Donald Williams to up to eight years in state prison followed by five years of post-release supervision.
On appeal, Evans maintained his plea was not knowingly, voluntarily and intelligently entered due to his attorney’s ineffectiveness, that the sentence was unduly harsh and excessive and that he was denied his constitutional right to a speedy trial.
The Appellate Division, Third Department, found each of his claims to be either without merit or unpreserved for the court’s review
