Orange County lawmakers support DEC in CPV battle

GOSHEN – The Orange County Legislature adopted a memorializing resolution on Thursday, urging the state to take whatever legal action is necessary to challenge a federal decision concerning the CPV electric generating plant in Wawayanda.
The DEC recently denied certain permits contending insufficient environmental review was conducted, but the Federal Energy Regulatory Commission overturned that decision.  The state had said it would consider challenging the FERC decision and the county move supports that.
Another resolution, proposed by Legislator Jeffrey Berkman, encouraged the state attorney general and Department of Health to further study the impacts of allowing the plant to operate. That was not approved by lawmakers.
The vote to support the DEC was approved 13-1 with six lawmakers abstaining for a number of reasons including potential conflicts of interest.
