Appeals court upholds drug possession conviction

KINGSTON – The Appellate
Division of State Supreme Court Third Department has affirmed the conviction
of a man found guilty in Ulster County Court on drug charges.

In March 2015, Jason Berry pled guilty to the felony of criminal possession
of a controlled substance.

As a second felony drug offender, he was sentenced to up to eight years
in state prison followed by three years of post-release supervision.

On appeal, Berry claimed he was improperly sentenced as a predicate felony
offender. That was rejected by the appellate court.
