Appellate court upholds drug possession conviction

KINGSTON – The Appellate Division, Third Department, of State Supreme Court, has affirmed the August 2011 conviction of a man who pled guilty in Ulster County Court to a charge of criminal possession of a controlled substance, two ounces of cocaine.
In June 2011 Arnayis Franklin, also known as Artie and Arnie, pled guilty in exchange for a state prison term of seven years to be followed by two years of post-release supervision.
On Appeal, Franklin argued the underlying indictment was jurisdictionally defective, that he was denied effective counsel, that county court erred in granting his request to represent himself at sentencing and that his already completed sentenced should be vacated due to the people’s failure to file a prior felony statement.
Those claims were determined to be baseless and rejected by the Appellate Court.
